RESIDENTIAL PURCHASES

In Ontario, a lawyer insured to practice real estate law in Ontario is the only person who can register the deed when you purchase a property. The lawyer will complete a title search ensure you have valid title to the property, ensure mortgage or liens are discharged on closing, arrange title insurance, prepare mortgage documents and act for the lender, draft documents, prepare financials including obtaining mortgage funds and calculating and paying land transfer tax, deliver funds to the seller, register the deed and mortgage and work with you to obtain keys to the property. Additional services can include reviewing the Agreement of Purchase and Sale and other legal documents, ensuring property taxes are up to date, searching zoning of the property, prepare co-ownership agreements, and ensure there are no work orders against the property.

RESIDENTIAL SALES

In order to sell a property in Ontario, you will require the services of a lawyer ensured to practice real estate law in Ontario. The lawyer will prepare the deed to your property, draft documents, ensure all legal conditions have been met, close the transaction, arrange to pay out and discharge any mortgages, liens and executions on title and deliver proceeds to you. They can provide a variety of additional services including reviewing the Agreement of Purchase and Sale before you sign and assisting with the negotiation of terms and conditions and preparing the Agreement of Purchase and Sale if you are selling without a real estate agent.

CONDOMINIUM PURCHASES
& SALES

In addition to providing the services noted above, lawyers can review the Status Certificate of a condominium when you purchase, which is a document that outlines the details and current standing of a condominium. The lawyer will ensure the condominium fees match those in the Agreement, the proper units (including parking and locker) are being transferred, there are no ongoing or pending lawsuits, reserve fund studies are up to date, determine any upcoming increases in the condominium fees, and the condominium is financially The lawyer can also provide information about the benefits and unique issues of condominium ownership.

Refinances & Transfers

If you are refinancing, you may be able to work internally with the lender. In some circumstances a lender still requires a lawyer to complete the refinance. The work on a refinance is similar to that on a purchase but instead of advising the client of the legal issues surrounding the property, the lawyer will be advising the lender (who they also act for). The lender may also require the lawyer to pay out debts of the clients, including prior mortgages, credit cards, lines of credits and car loans. Any proceeds, like in a sale, will then be paid directly to the client from the lawyer.
